Jack had managed to exceed his sales targets to such an extent that the owner thought the monthly commission payments were over generous, as new business flooded into the company and allowed our client to have a package similar to the net profit of the company. The business owner delayed payment gradually until many months of commission were owed.
Jack was very frustrated by being constantly under paid and in fact he was in a position, if he wished to set up a rival manufacturing business in view of his client base. We advised Jack to commence an unfair constructive dismissal claim, so that he could claim for his commission payments and also for damages for unfair dismissal whilst he set up a rival business. The post termination covenants in Jack’s employment contract fell away due to the serious breach of non payment of commission by his employer.
