A Constructive Dismissal claim to be successful has to satisfy the following conditions:-

The Breach

• The employer has breached a term of the employment contract

Fundamental Term

• The term(s) breached was a fundamental term of the employment contract

Acceptance and Waiver

• The employee resigns very quickly on account of the serious breach, and has not done anything to suggest an acceptance of the employer’s breach
